References to “you”, “your”, “client”, “customer” or “participant” mean the person purchasing, booking or participating in a product or service.
2. Scope of These Terms
These Terms & Conditions apply to:
portrait and headshot photography sessions;
personal-branding and other commissioned photography;
photography tuition and workshops;
private photography tours;
studio hire, where offered;
fine-art photography prints and other physical products;
website content and online purchases.
Additional information shown on an individual service page, product page, quotation, invoice or booking confirmation forms part of the agreement between us.
If there is a conflict between these general terms and a specific written quotation or booking agreement, the specific written agreement will take precedence.
Nothing in these terms limits any mandatory rights you may have under Portuguese or European Union consumer law.
3. Website Information
I take reasonable care to ensure that the information, descriptions, prices and photographs shown on this website are accurate.
Minor errors, omissions or technical issues may occasionally occur. I reserve the right to correct an obvious error before accepting an order or booking.
Images displayed on screens may vary slightly in colour, brightness or contrast because of differences between monitors, browsers and device settings.
The availability of a service, date, location or product is not guaranteed until your order or booking has been accepted and confirmed.
4. Prices and Payment
All prices are shown in euros unless stated otherwise.
Prices include any applicable taxes unless the relevant product page, quotation or invoice states otherwise.
Payment must be made using one of the payment methods offered at checkout or stated on the invoice.
A booking is not confirmed until:
the required payment has been received; and
written confirmation has been issued.
Where a deposit or part-payment arrangement has been agreed, the remaining balance must be paid by the date shown on the invoice or confirmation.
Failure to pay an amount by its due date may result in the booking being cancelled.
You are responsible for any bank, foreign-exchange or payment-provider charges imposed by your own provider.
5. Formation of the Contract
Placing an order or making a payment constitutes an offer to purchase the relevant product or service.
An automated payment receipt or order acknowledgement does not necessarily mean that the order has been accepted.
The contract is formed when I send written confirmation accepting the order or booking.
For tuition, workshops, photo tours or photography sessions purchased before a date has been agreed, the booking date remains provisional until it has been confirmed in writing.
You should not make non-refundable travel, accommodation or other arrangements until the booking date and meeting details have been confirmed.
6. Booking Information
You must provide accurate information when making a booking, including:
your full name and contact information;
the number of participants;
the selected service and duration;
relevant photography experience;
equipment information where appropriate;
mobility, access or medical matters that may affect participation;
any particular requirements discussed before booking.
The person making a group booking is responsible for ensuring that all participants have read and accepted these terms.
Prices for private tuition, workshops and photo tours are based on the number of participants selected during checkout.
Additional participants may not attend unless agreed in advance and any additional charge has been paid.
7. Consumer Right of Withdrawal
7.1 Services Purchased Online
Where you are acting as a consumer and purchase a service online, you will normally have the right to withdraw from the contract within 14 calendar days from the date the contract is concluded, without giving a reason.
You may exercise this right by emailing an unequivocal statement that you wish to withdraw, or by using the model withdrawal form at the end of these terms.
7.2 Services Beginning Within 14 Days
Where you ask for a service to begin during the 14-day withdrawal period, I will require your express request in writing or through another durable medium before the service begins.
If you subsequently withdraw after part of the service has been provided, you may be required to pay a proportionate amount for the work already completed.
If a service is fully performed during the withdrawal period following your express request and acknowledgment, the statutory right of withdrawal may end once the service has been completed.
7.3 Specific-Date Leisure Services
The statutory right of withdrawal may not apply where the law excludes it, including certain services connected with leisure activities where the contract provides for a specific date or period of performance.
This may apply to some confirmed photography tours, tuition sessions or workshops booked for a particular date.
7.4 Fine-Art Prints
For standard fine-art print orders purchased online, the withdrawal period normally expires 14 calendar days after you, or a person nominated by you, receives the order.
The right of withdrawal may not apply to prints or other goods that are made to your individual specifications, produced in a non-standard size, personalised or otherwise clearly customised.
7.5 Statutory Rights Take Priority
The cancellation provisions below do not replace or reduce any statutory withdrawal right that applies to your purchase.
8. Client Cancellation of a Confirmed Service
The following commercial cancellation policy applies after any applicable statutory withdrawal period has expired, or where no statutory right of withdrawal applies.
8.1 Cancellation More Than 28 Days Before the Booking
If you cancel more than 28 calendar days before the confirmed booking date, you will receive an 80% refund of the amount paid.
The retained 20% covers the reservation of the date, administration and preparatory work.
8.2 Cancellation Between 15 and 28 Days Before the Booking
If you cancel between 15 and 28 calendar days before the confirmed booking date, you will receive a 50% refund of the amount paid.
8.3 Cancellation 14 Days or Less Before the Booking
Payments are non-refundable where cancellation is made 14 calendar days or less before the confirmed booking date.
8.4 No-Shows
If you fail to attend without notice, the full booking fee remains payable and no refund will be issued.
8.5 Rebooking a Cancelled Date
Where I am able to secure another full-price booking for the cancelled date, I may, at my discretion, reduce the cancellation charge.
This does not create an automatic entitlement to an additional refund.
9. Client Requests to Reschedule
One request to transfer a booking to another date may be accepted without an additional fee where:
at least 15 calendar days’ notice is given;
the requested new date is available; and
the rescheduled service takes place within six months of the original date.
Further date changes may be treated as a cancellation.
Requests made fewer than 15 days before the booking are subject to availability and may be treated as a cancellation under section 8.
Any non-refundable third-party costs already incurred, including studio, venue, permit, assistant or makeup-artist costs, remain payable.
10. Cancellation or Rescheduling by Glyn Parry Photo
I may cancel, postpone or change a booking where necessary because of:
illness or injury;
unsafe weather or sea conditions;
location closure or restricted access;
equipment failure;
transport disruption;
government restrictions;
an emergency;
another circumstance outside my reasonable control.
Where I cancel and cannot provide a reasonable alternative date, you will receive a full refund of the amount paid for the affected service.
Where the booking is postponed, payments may be transferred to a mutually agreed alternative date.
I am not responsible for separate travel, accommodation, vehicle-hire or other costs incurred by you.
11. Weather and Outdoor Conditions
Photography tuition, workshops, portraits and photo tours may be affected by weather, tides, sea conditions, access, visitor numbers and changing natural light.
Cloud, wind or changing light does not automatically mean that a booking will be cancelled.
Locations, meeting times and the order of activities may be adjusted to provide safer or more suitable conditions.
Safety takes priority over the originally planned location or itinerary.
Where conditions make the service unsafe or impractical, I will offer an alternative location or date.
If no mutually suitable alternative date can be agreed within six months, the amount paid for the affected service will be refunded.
12. Punctuality and Duration
You should arrive at the agreed meeting point at the confirmed time.
If you arrive late, the session may still finish at the originally agreed time, particularly where timing depends on sunrise, sunset, studio availability or another booking.
No refund is due for time lost because of late arrival.
Where you are substantially late and cannot be contacted, the booking may be treated as a no-show.
13. Photography Tuition and Workshops
Photography tuition and workshops are adapted to the participant’s experience, equipment and stated goals.
You are responsible for bringing:
a functioning camera and suitable lenses;
charged batteries and memory cards;
a tripod or filters where advised;
suitable clothing and footwear;
any personal medication or mobility equipment required.
Unless expressly agreed, equipment is not supplied.
Tuition is educational and practical, but no guarantee is made that a participant will achieve a particular qualification, professional standard, commercial outcome or photographic result.
Progress depends partly on the participant’s experience, practice, equipment and engagement.
14. Photography Tours
Photography tours are designed primarily around photographic locations, conditions and available light. They are not general sightseeing tours.
The exact itinerary may change according to:
weather;
tides and sea conditions;
seasonal light;
access restrictions;
safety;
visitor levels;
the experience and interests of participants.
Transport is not included unless expressly stated.
Participants normally travel to and between locations using their own vehicle or rental vehicle.
Accommodation, meals, refreshments, equipment and personal insurance are not included unless expressly stated.
A particular location, sunrise, sunset, cloud formation, tide, wildlife sighting or photograph cannot be guaranteed.
15. Safety and Participant Responsibility
You remain responsible for your own personal safety and property.
Outdoor locations may include:
uneven ground;
sand;
rocks;
steps;
inclines;
wet or slippery surfaces;
coastal paths;
low-light conditions.
You must:
wear appropriate footwear and clothing;
remain within safe and permitted areas;
follow reasonable safety instructions;
avoid unnecessary risk;
inform me in advance of relevant mobility or health concerns.
I may change or end an activity where I reasonably believe that conditions or participant behaviour create a safety risk.
You are responsible for your own camera equipment, vehicles and personal belongings.
Personal, travel, accident and equipment insurance are strongly recommended.
16. Conduct
Participants must behave respectfully and must not:
endanger themselves or others;
damage property or the environment;
enter restricted or unsafe areas;
behave abusively, unlawfully or disruptively;
ignore reasonable safety instructions.
I may end a service immediately where behaviour creates a significant safety, legal or operational concern.
Where a service is ended because of a participant’s conduct, no refund will normally be issued.
17. Children and Participants Under 18
Participants under 18 may attend only by prior agreement.
They must be accompanied and supervised by a parent, legal guardian or another responsible participating adult.
The adult making the booking is responsible for the minor throughout the session.
Written parental or guardian consent may be required for photography involving a minor.
18. Portraits, Headshots and Commissioned Photography
The client must provide accurate information about:
the intended use of the photographs;
the number of people being photographed;
locations;
deadlines;
styling requirements;
image dimensions or formats;
any third-party requirements.
The client is responsible for obtaining access permission for any private location selected by the client.
Additional costs such as studio hire, permits, parking, makeup artists, stylists, assistants, props or specialist equipment will be charged where agreed.
19. Artistic Style and Image Selection
By booking a photography service, you acknowledge that you have reviewed my portfolio and understand my photographic and editing style.
Photography involves artistic judgment.
I retain discretion over:
composition;
lighting;
posing;
image selection;
cropping;
colour treatment;
retouching;
final presentation.
Not every photograph taken during a session will be delivered.
Images that are duplicates, test frames, technically unsuitable or inconsistent with the agreed result may be removed during selection.
Unedited RAW files are not supplied unless agreed in writing before the booking.
20. Image Delivery
The number, format and delivery method of final images will be stated on the relevant service page, quotation, invoice or booking confirmation.
Delivery dates are estimates unless a fixed deadline has been agreed in writing.
You should download and securely back up delivered files promptly.
I do not guarantee indefinite storage or replacement of images after delivery.
Requests for extensive retouching, additional images, alternative crops or changes beyond the agreed service may incur an additional charge.
21. Client Approval and Corrections
You should inspect delivered images or products promptly.
Any concern relating to an obvious error, missing agreed item or technical defect should be reported as soon as reasonably possible.
Aesthetic preference alone does not necessarily constitute a defect where the work is consistent with the portfolio and agreed brief.
Where I have made an objective error, I will take reasonable steps to correct it.
22. Copyright in Photographs
Unless otherwise agreed in writing, copyright in all photographs remains with Glyn Parry Photo.
Purchasing a photography service or print does not transfer copyright.
You receive the usage rights included in the relevant package, quotation or licence.
For personal portraits and headshots, this will normally include personal use and reasonable self-promotional use, such as:
personal websites;
CVs;
professional profiles;
LinkedIn;
social media;
press biographies.
Photographs may not be resold, licensed to third parties, entered into commercial image libraries or used in paid advertising without written permission where such use was not included in the original agreement.
23. Client Materials and Third-Party Rights
Where you provide logos, artwork, text, reference images, products or other materials, you confirm that you have permission to use them.
You are responsible for any claim arising from materials supplied by you that infringe another person’s copyright, trademark, privacy or other rights.
24. Promotional Use of Client Images
I will not use identifiable client photographs for my website, portfolio, social media, exhibitions, competitions or marketing without separate permission where consent is legally required.
Consent for promotional use is optional and is not a condition of receiving the photography service.
Any consent should be recorded separately and may be withdrawn for future use, subject to material already lawfully published or printed.
25. Studio Hire
Where studio hire is offered, the person making the booking is responsible for:
supervising all attendees;
using equipment safely;
complying with maximum occupancy;
leaving the studio in a reasonable condition;
reporting damage immediately;
paying for damage caused by misuse or negligence.
Studio time includes setup and clearing time unless expressly stated otherwise.
Overrunning the booked period may incur an additional charge or may not be possible where another booking follows.
Food, smoking, hazardous materials, open flames, illegal activity and unsafe use of equipment are prohibited unless expressly authorised.
26. Fine-Art Print Orders
Fine-art prints are produced and packed with care.
Product descriptions include the available size, paper, edition and presentation information where applicable.
Frames are not included unless expressly stated.
Minor differences may occur between the image shown on screen and the physical print because of screen calibration, paper surface, printing processes and viewing light.
These reasonable variations do not affect your statutory rights where a product is defective or materially different from its description.
27. Delivery of Physical Products
Delivery estimates are given in good faith but are not guaranteed unless expressly agreed.
You must provide a complete and accurate delivery address.
Additional delivery costs caused by an incorrect or incomplete address may be charged to you.
For deliveries outside Portugal or the European Union, you are responsible for any customs duties, import taxes or local handling charges.
Risk in goods passes to a consumer when the consumer, or a person nominated by the consumer, receives physical possession of them, except where the consumer independently appoints a carrier not offered by me.
28. Returns of Standard Fine-Art Prints
To exercise a statutory right of withdrawal for an eligible standard print, you must notify me within 14 calendar days after receiving it.
After notifying me, you must return the print within a further 14 calendar days.
The print must be securely packaged and handled no more than reasonably necessary to inspect its nature and characteristics.
You are responsible for the direct cost and safe transport of a non-defective return unless agreed otherwise.
A tracked and insured return service is recommended.
A refund will be made using the original payment method, subject to the applicable legal rules.
I may withhold the refund until the returned item is received or until you provide evidence that it has been sent.
You may be responsible for any reduction in value caused by handling beyond what would reasonably be permitted when inspecting the product.
29. Personalised and Custom Products
The statutory right to return may not apply to goods produced according to your individual specifications or clearly personalised.
This may include:
non-standard print sizes;
custom mounting or framing;
individually commissioned print treatments;
personalised inscriptions;
other bespoke orders.
This does not affect your rights where the product is defective, damaged or not as described.
30. Damaged, Defective or Incorrect Products
If a product arrives damaged, defective or incorrect, contact me promptly and provide:
the order number;
a description of the issue;
photographs of the product and packaging where reasonably possible.
Do not dispose of the product or packaging until the issue has been reviewed.
Depending on the circumstances and applicable law, an appropriate remedy may include repair, replacement, price reduction or refund.
Nothing in these terms limits the statutory guarantee of conformity applicable to consumer goods.
31. Intellectual Property on the Website
All photographs, text, graphics, logos, layouts and other original website content are protected by copyright and other intellectual-property rights.
They may not be copied, downloaded, reproduced, altered, republished, sold or used commercially without prior written permission.
Sharing a normal link to a public page is permitted.
Purchase of a print gives ownership of the physical print only and does not transfer copyright or reproduction rights.
32. Privacy and Personal Data
Personal data is handled in accordance with the separate Privacy Policy.
Personal information may be processed where necessary to:
respond to enquiries;
manage bookings;
process payments;
fulfil orders;
deliver services;
comply with legal and accounting obligations.
Data may be processed by necessary service providers such as Squarespace, payment processors, email providers and delivery companies.
Personal information is not sold to advertisers.
33. Liability
I will provide services with reasonable care and skill.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
deliberate misconduct;
breach of mandatory consumer rights.
I am responsible for loss or damage that is a foreseeable result of my breach of contract or failure to use reasonable care and skill.
I am not responsible for loss that was not reasonably foreseeable when the contract was formed.
Where you are acting as a consumer, I am not responsible for business losses arising from your use of a service or product for commercial purposes.
Where you are acting wholly or mainly for business purposes, and to the extent permitted by law, my total contractual liability will not exceed the total amount paid for the relevant service or order.
I am not responsible for damage to participant equipment or personal property unless caused by my negligence or deliberate act.
34. Events Outside Reasonable Control
Neither party will be responsible for delay or failure caused by events beyond reasonable control.
Such events may include:
severe weather;
fire or flood;
illness or accident;
epidemic or government restriction;
transport disruption;
location closure;
civil disturbance;
utility or communications failure;
failure of an essential third-party supplier.
Where performance becomes impossible, I will offer an appropriate rescheduling, credit or refund for the unperformed part of the service, subject to applicable law.
35. Complaints
Please raise any concern first by contacting:
I will make reasonable efforts to investigate and resolve the matter directly.
Consumers may also submit a complaint through the official Portuguese Electronic Complaints Book — Livro de Reclamações Eletrónico.
36. Alternative Dispute Resolution
In the event of a consumer dispute that cannot be resolved directly, the consumer may contact:
CIMAAL — Centro de Informação, Mediação e Arbitragem de Conflitos de Consumo do Algarve
Address: Avenida 5 de Outubro, n.º 55, R/C Direito, 8000-075 Faro, Portugal
Telephone: +351 289 823 135
Email: info@consumoalgarve.pt
Further information is available through the CIMAAL website and the Portuguese Consumer Portal.
Use of an alternative dispute-resolution body does not remove any right to use the courts where legally available.
37. Governing Law and Jurisdiction
These terms and any contract formed under them are governed by Portuguese law.
Where you are a consumer resident in another country, you retain any mandatory consumer protections that apply under the law of your country of residence.
Any dispute may be submitted to the competent Portuguese courts, without limiting any mandatory consumer right to bring proceedings in another competent jurisdiction.
38. Changes to These Terms
I may update these terms to reflect changes in the business, services or applicable law.
Changes apply prospectively.
The version in force when your order or booking is accepted will normally govern that contract unless a change is required by law or expressly agreed by both parties.
The latest version will be published on this website with the date of the update.
39. Severability
If any provision of these terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect.
The invalid provision will be interpreted or adjusted only to the minimum extent necessary to make it lawful and enforceable.
40. Entire Agreement
These terms, together with the relevant product page, service description, quotation, invoice, privacy policy, return policy and written booking confirmation, constitute the agreement between the parties.
No oral statement forms part of the agreement unless confirmed in writing.
